Ohio Supreme Court Refuses to Clarify Fatal Fire Apparatus Ruling

The Ohio Supreme Court has rejected a request from Massillon to clarify its recent decision in a wrongful death lawsuit filed after a 2008 firetruck crash that killed a city man and his step-grandson.

City attorneys had sought clarification of the remedies provided by the Supreme Count. Last month, the court ruled that a trial court should reconsider whether the city was liable in the crash that killed Ronald Anderson, 72, and his stepgrandson, Javarre Tate, 4.

In 2010, the Stark County Common Pleas Court granted the city immunity in the case, but in March 2011 the 5th District Court of Appeals reversed the decision.
